SMS TERMS OF SERVICE
These SMS Terms of Service (the "SMS Terms") govern text messages sent by or on behalf of AB POS Solutions, Inc. ("AB POS," "we," "us," or "our"). By providing your mobile telephone number and affirmatively opting in to an applicable messaging program, you acknowledge that you have read and agree to these SMS Terms.
1. Consent to Receive SMS Messages
You may opt in through our website, customer or merchant forms, support requests, account enrollment, installation or service workflows, keyword-based enrollment, or other communication channels authorized by AB POS. By opting in, you expressly consent to receive SMS or MMS messages at the mobile number you provided, including messages sent using an automatic telephone dialing system or other automated technology, where permitted by law.
Messages may relate to your account or business relationship with AB POS, including:
- Account notifications, authentication notices, and security alerts;
- Order updates, transaction-related notices, and service confirmations;
- Appointment reminders, installation scheduling, and operational communications;
- Support follow-ups, incident notices, and technical or product updates; and
- Special offers, product announcements, and promotional communications, when separately authorized or otherwise permitted by law.
Consent to receive promotional text messages is not a condition of purchasing any product or service. You represent that you are the subscriber or customary user of the mobile number provided and that you are authorized to provide the consent described above. If your number changes or is reassigned, you agree to notify us promptly and opt out before discontinuing use of that number.

Message frequency varies based on your account activity, selected services, communication preferences, and interactions with AB POS. You may receive recurring messages while enrolled in an applicable messaging program.
3. Message and Data Rates
Message and data rates may apply under your wireless carrier's plan. You are solely responsible for charges imposed by your carrier. AB POS does not charge a separate fee solely for participating in its SMS program, although charges for underlying products or services may apply.
4. Opt-Out Instructions
You may withdraw your consent and unsubscribe at any time by replying STOP to a message from AB POS. We may send one final confirmation message stating that your opt-out request has been processed. After that confirmation, you will no longer receive messages from the applicable SMS program unless you opt in again.
Depending on the messaging program and applicable law, opting out of promotional messages may not prevent AB POS from sending non-promotional messages that are necessary to provide a requested service, protect an account, confirm a transaction, respond to you, or satisfy a legal obligation. Where separate programs use different originating numbers, you may need to opt out from each program individually.

Your privacy is important to us. We do not sell or rent your personal information. We do not share SMS opt-in consent with third parties or affiliates for their own marketing or promotional purposes. We may disclose information to service providers that assist us in delivering messages or operating our services, subject to appropriate confidentiality and data-protection obligations, and when disclosure is required by law.

7. Carrier and Service Availability
Delivery of text messages is subject to the availability and performance of wireless networks and participating carriers. Carriers are not liable for delayed or undelivered messages. AB POS does not guarantee that any message will be delivered or received within a specific time. Supported carriers and program availability may change without notice.
8. User Responsibilities
You agree not to use the SMS program for unlawful, abusive, fraudulent, or unauthorized purposes. You are responsible for maintaining the security of your mobile device and for reviewing messages received at the number you provide. If you believe your account, mobile number, or device has been compromised, contact AB POS promptly.
9. Changes to These SMS Terms
AB POS may amend these SMS Terms from time to time to reflect changes in applicable law, carrier requirements, technology, or our business practices. Updated SMS Terms will be posted at https://abpos.com/terms and will become effective on the date stated in the updated version. Your continued participation after the effective date constitutes acceptance of the revised SMS Terms to the extent permitted by law.
10. Suspension or Termination
AB POS may suspend, modify, or discontinue an SMS program, in whole or in part, at any time, including when necessary to comply with legal, carrier, security, or operational requirements. Termination of an SMS program does not alter rights or obligations that accrued before termination.
